An investment report is a mandatory obligation for Investors and Foreign Invested Enterprises in Vietnam. Compliance with reporting obligations is the basis for competent state authority to consider the dossier that changed the information about operation of the investment project dossier, as well as avoiding penalties for investors and Enterprises.

Report on investment activity in Vietnam

In a year, the enterprise shall perform Quarterly and Annual Report. Quarterly Report shall be submitted by the 10th of the first month of the following Quarter (after the Quarter to be reported).

The Annual Report shall be made by March 31 of the next year (after the year to be reported).

Thus, for this type of report, the enterprise shall submit 04 Quarterly Reports for 04 Quarters and 01 Annual Report.

Report on investment monitoring and evaluation

This is a type of report for the purpose of monitoring and evaluation of the effectiveness of an investment project. For each investment project, the Enterprise shall make a six-month report and an Annual report on investment monitoring and evaluation. The six-month report shall be completed and submitted by July 10 (the year to be reported) and the Annual report shall be completed by February 10 of next year (after the year to be reported)

Penalty when the enterprise violates reporting obligations

 A penalty ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for one of the following acts:

• Making reports on investment monitoring and evaluation reports not on time or with incomplete contents as prescribed;
• Failing to implement the regime of periodic investment monitoring and evaluation reports as prescribed.

A penalty ranging from VND 30,000,000 to VND 50,000,000 shall be imposed for any of the following violations:

• Failure to comply with regulations on reporting investment activity or failing to report on time as prescribed;
• Reporting dishonestly and inaccurately on investment activity;

The Enterprise needs to pay attention to reporting time-limit to maintain compliance and avoid penalties for the enterprise.
